Terms and Conditions

1) Use of this site constitutes your acceptance of these terms and conditions which take effect at the time you first access the site.

2) If you do not accept these terms and conditions you must not use this site or the services.

3) Ashfield Services reserves the right to change these terms and conditions at any time by posting changes online. It is your responsibility to refer to these terms and conditions on accessing this site.

4) Continued use of this site after such changes to the terms and conditions constitutes acceptance of those posted changes.

5) Where a course is booked and date of course session is agreed within 14 days from the date of the booking, the cooling off period does not apply.

COVID-19/Norovirus/Other Infectious Diseases/Viruses

 

As a company within the Health & Social Care industry, we understand all organisations have experienced difficulties, especially the last 4 years specifically and recognise the commitment each organisation have made to preventing the spread of COVID-19 and ensuring safety for service users, staff and visitors.

 

On every occasion, Ashfield Services have worked fairly, closely and reactively to any and all situations where a training course is affected by an infectious disease/virus, especially COVID-19 of late. In some cases, this is at the detriment of Ashfield Services and their Tutors.

Since the latest changes to Government guidance, with COVID-19 being downgraded to a respiratory infection/disease, any requirement to reschedule or cancel training booked will revert to the below standard T&Cs.

Ashfield Services will continue to work with our clients on establishing appropriate solutions to ensure booked training can proceed as scheduled, in order to avoid charges being incurred. 

In House/Onsite Course Bookings

 

Your Booking:

All Onsite bookings are confirmed at the point of booking with a member of the Sales Department. The member of the Sales Department will confirm the course subject and price with the Client and secure that Onsite session. The Client will receive confirmation that the course has been secured and will then be passed to the Admin team to source dates. From this point, we offer a “cooling off period” as is your right as a consumer, therefore should you need to use this “cooling off period” to cancel the Onsite session booked, please put this into writing within 14 days of the date of booking to cancel@ashfieldservices.co.uk. All cancellations must be acknowledged in writing by Ashfield Services. Further cancellation terms can be found below in “Rescheduling & Cancellation”.

Clients are to provide a suitable training environment, which adheres to Health and Safety regulations. Ensuring all Ashfield Services representatives are provided with safe and comfortable surroundings with refreshments available for the duration of their visit to the client’s premises.

Ashfield Services will provide the Client with handouts and resources via email. It is the Clients responsibility to print and supply delegates with these resources and handouts for the booked course. Printed Handouts can be ordered at £9.99 per delegate to cover printing and postage charges. Please speak with the Ashfield Services team if these are required.

Certificates are generated and issued using the Attendee Register from the beginning of the course. These certificates are emailed to the Client who made the booking (unless advised differently). Please ensure that delegates attending the training course completes the Attendee Sheet clearly as any certificate amendments may incur a charge. Should you choose for your certificates to be printed and posted by Ashfield Services, this can be arranged at a cost of £10.00 +VAT per certificate.

Clients are to ensure that the venues details are supplied to Ashfield Services within 10 days of a date agreement and provide details of any special requirements for the scheduled course in the same timescale.

Clients must notify Ashfield Services if the address to receive any equipment differs to that of the venue address. Courier charges may apply if Ashfield Services is not notified within 7 days before the date of the course.

Clients must ensure that all equipment received is responsibly looked after by the Client until it is re-collected by the Ashfield Services chosen courier company.

From time to time, Clients may request a specific Associate Tutor for the delivery of a training course booked with Ashfield Services. Ashfield Services will endeavour to fulfil these specific requests, however should the chosen Associate Tutor not be available on the date selected by the Customer, or for any reason the Associate Tutor is unable to teach, an alternative associate tutor of the same calibre and clinical expertise will be sourced to provide the training in their place. This will not detract from the quality of the training or the subject matter being delivered.

Payment:

All prices quoted on the website are exclusive of VAT and service charges.

All Onsite courses will be invoiced on the day the training takes place and is payable within 30 days of the invoice, unless alternative payment terms have been agreed in writing. 

Payment of the invoice must be made in full and inclusive of VAT. Failure to pay may result in your course being cancelled or postponed to a later date or certificates not being issued until payment is received. If payment is not received 14 days after the “Invoice Due Date”, Late Payment Interest will be applied and reasonable recovery costs will be incurred at an additional charge of £60, to cover administrations costs and details passed on to credit reference agencies which may affect your future credit rating.

Ashfield Services reserve the right to cancel, reschedule, or hold future courses that are scheduled, should payment for previous courses delivered breach 60 days from their respective due date.

Rescheduling:

Should you need to reschedule the date of your Onsite course, this can be done easily by contacting transfer@ashfieldservices.co.uk however in some circumstances, charges may apply. Charges will only apply if we receive notification of request to reschedule within the below time frames:

30 or more days notice - 1 reschedule provided free of charge, £100 thereafter per reschedule

11 - 29 days notice – £100 charge

10 or less days notice – 100% course value charge
 

Where a course is booked and date of course session is agreed within 14 days from the date of the booking, the cooling off period does not apply, yet above reschedule fees do still apply in the event the session needs to be rescheduled.

In the event that Ashfield Services needs to reschedule an Onsite training course, at least 7 days’ notice will be given and a new date will be provided at no further cost. If the new date offered is not suitable, then then the Admin team will work with the Client in sourcing a new, suitable date.

Cancellation:

We would like to offer the “cooling off period” as is your right as a consumer, therefore should you need to use this “cooling off period” to cancel your Onsite session(s), please put this into writing within 14 days of the date of booking to cancel@ashfieldservices.co.uk. All cancellations must be acknowledged in writing by Ashfield Services. Please note that if you do not cancel in writing and/or do not attend, fees already paid will not be refunded or transferable and any outstanding invoices will still be due.

In order for Ashfield Services to continue offering high quality training at a low cost fee, any cancellations for Onsite courses made outside of the 14 day cooling off period, will incur a cancellation fee of 50% of the order value, or 100% of the order value if a scheduled course is cancelled within 10 or less days notice (irrespective of when the course was booked).

Unless otherwise agreed, a date for the Onsite course(s) must be chosen and confirmed between Ashfield Services and the Client within 30 days of the booked course. If Ashfield Services continues to provide availability for the course and the Client is unable to confirm a selected date within 30 days of when the booking was made, or we continue to receive no response from the organisation, Ashfield Services reserve the right to cancel the course at a cost of the full order value to the customer.

Ashfield Services reserve the right to at any time to change the date of an Onsite course or to cancel it altogether if they deem it necessary for any reason or cause beyond the control of Ashfield Services, such as adverse weather conditions, tutor illness, road traffic accidents etc. An alternative date will be provided at the earliest opportunity at no further cost.

Failure to adhere to these terms and conditions may result in any discount given being removed.

Bespoke Course Development

Ashfield Services offer a bespoke course development service whereby a course can be altered or developed to meet your organisations specific needs. The cost of this service is not included within the price charged for the delivery of the course itself and is charged at the point of booking, payable within 7 days of issued invoice, for the service provided of developing the materials to meet your specific needs.

The charges are as follows:

  • Mandatory Subject: £499 +VAT per day of development

  • Clinical Subject: £599 +VAT per day of development

  • Specialist Subject: £799 +VAT per day of development

Should you wish to cancel a course you have booked that requires bespoke development, the cancellation T&Cs above will stand for the “Course” itself and not the development service. Cancellations for bespoke course development must be received within 48 hours of the booking being placed. Any requests for cancellation outside of this period are subject to no refunds and the invoice for the course development is payable in full and inclusive of VAT within 30 days of being issued.

Virtual Course Bookings

Your Booking:

All Virtual Course bookings are confirmed at the point of booking with a member of the Ashfield team via email or telephone. The member of the team will confirm the course subject and price with the Client and secure that Virtual Course. At this point, your booking is placed and these Terms & Conditions are applicable to the booking. The Client will receive confirmation that the course has been secured and will then be passed to the Admin team to source date(s) and time(s) that are suitable. 

Clients are to provide suitable equipment and a reliable internet connection for delegates to access the virtual classroom and ensure this equipment and internet speeds meet the required standards as set out by Zoom, here: https://support.zoom.us/hc/en-us/articles/201362023-System-Requirements-for-PC-Mac-and-Linux

Ashfield Services cannot be held liable for poor internet connection issues, poor quality video output or the inability for a delegate to access the training due to the equipment not meeting the required standards as set out by Zoom. 

Ashfield Services will provide the Client with handouts and resources via email. It is the Clients responsibility to forward these to delegates attending the virtual course. They do not need to be printed, however we do recommend they are as the delegate will have a smoother and easier experience during the virtual course. Printed Handouts can be ordered at £9.99 per delegate. Please speak with the Ashfield Services team if these are required.

Certificates are generated and issued using the Attendee Register from the beginning of the course. These certificates are emailed to the Client who made the booking (unless advised differently) and to delegates individually that provide an email address. Please ensure that delegates attending the training course completes the Attendee Sheet clearly as any certificate amendments may incur a charge. Should you choose for your certificates to be printed and posted by Ashfield Services, this can be arranged at a cost of £10.00 +VAT per certificate, plus £4.99 P&P.

Clients are to ensure that delegate details are supplied to Ashfield Services within 1 working day before commencement of the virtual course. Fees may be incurred should sessions not be able to run if this information is not provided.

From time to time, Clients may request a specific Associate Tutor for the delivery of a training course booked with Ashfield Services. Ashfield Services will endeavour to fulfil these specific requests, however should the chosen Associate Tutor not be available on the date selected by the Customer, or for any reason the Associate Tutor is unable to teach, an alternative associate tutor of the same calibre and clinical expertise will be sourced to provide the training in their place. This will not detract from the quality of the training or the subject matter being delivered.

Payment:

All Virtual courses will be invoiced on the 1st day of the month that each training course falls within and is payable within 30 days of the invoice, or 7 days after the course (whichever is sooner), unless alternative payment terms have been agreed in writing. (ie. Your course is scheduled on 14th February, you will be invoiced on 1st February for payment).

Failure to pay may result in your course being cancelled or postponed to a later date or certificates not being issued until payment is received. Remaining T&C’s:

Ashfield Services reserves the right to charge for additional delegates, above the maximum delegates advised to you at the point of booking. These will be charged at the rate per delegate, against your agreed course price and maximum numbers.

Ashfield Services Tutors have full discretion as to whether or not they will accept any latecomers to a course, whether the course be delivered face2face or virtually. Ashfield Services will not be held liable for any delegates unable to attend training, due to their late arrival. 

 

Courses booked cannot be re-sold or offered to any other organisation without the knowledge or consent of Ashfield Services. This may result in the course being cancelled/place/s being removed from the course or if a discounted rate is given, the full price will be charged for the course.

From time to time, Ashfield Services may introduce a discount on particular courses. These discounts may be introduced for a number of reasons, however any places booked prior to the release of this discount, will still be charged at the previously advertised and invoiced rate. If you wish to take advantage of the newly discounted rate, you may book additional place(s) at the discounted rate by quoting the discount advertised at the point of booking.

Ashfield Services Associate Tutors are responsible for the quality of the training undertaken and shall ensure that the training is performed with all reasonable care, and without limitation is wholly responsible for the training they provide, Ashfield Services will not be liable for any loss, damage, illness or injury to persons or property, however caused, except where such liability is imposed by law.

 

Any views or opinions presented on training sessions, not outlined on the advertised Ashfield Services course content(s) are solely those of the Associate Tutor and do not necessarily represent those of Ashfield Services. If you feel at any point that the training you have received does not meet your needs, or you feel is not up to current best practice and national guidelines, please notify Ashfield Services in writing, within 14 days after the course date so we can pass this on to the Clinical Team who will conduct a full investigation. Any feedback received after 14 days following a course will be acknowledged by Ashfield Services, however due to the period of time passed following the course, a full investigation may not be possible to allow for Ashfield to offer an appropriate resolution. For any staff member attending one of Ashfield Services courses, the employer should ensure that they are appropriately insured under the organisations indemnity insurance for undertaking the training course and any skills or activities that are included in the training session, and that this continues whilst they are undertaking these skills when working back in the clinical setting. For any individually funded courses, Ashfield Services public liability insurance will cover you for attending the course only, but will not extend to practicing the skill after attending if not employed within an organisation with appropriate indemnity insurance.

Failure to adhere to these terms and conditions may result in any discount given being removed.
